TERMS OF USE

This Agreement sets forth the terms and conditions of use of all services provided by tripmate K.K. (the "Company") (the "Services") between you ("you" or "User") and the Company. (hereinafter referred to as the "Service"). Please read these terms and conditions carefully before using the Service.

Article 1 (Agreement to the Terms)

By registering as a member and using the Service, you agree to be bound by these Terms. The user must use the Service in accordance with the provisions of this Agreement. Upon completion of the membership registration, the User will enter into a contract with the Company for the use of the Service (the "Contract"). We may change this Agreement and the Services from time to time. You should check the latest version of the Agreement regularly. If the changes involve material changes that affect your rights or obligations, we will give you reasonable advance notice of the changes (such as through the Service or by email). If you continue to use the Service after any changes are made, you agree to be bound by the revised agreement.

Article 2 (Application of the Terms)

If any of the provisions of these Terms and Conditions are contrary to the relevant laws and regulations applicable to the contract with the user under these Terms and Conditions, such provisions shall, to that extent, not apply to the contract with the user concerned. However, this shall not affect the validity of any other provision of these Terms and Conditions. (Terms of Use)

Article 3 (Contents of the Service)

This service is based on the concept of exchanging local information from around the world, and supports communication between people of different cultures to help each other and enjoy each other's company. This service is designed to help people from different cultures communicate with each other, help each other and have fun.

Article 4 (Eligibility)

You must be at least 18 years old to create an account on tripmate and use the service. By creating an account and using the service, you represent and warrant that If the user violates any of the following reasons, the Company may, at any time and without prior notice to the user, change all or part of the Service, refuse membership registration, delete membership information, or discontinue providing the Service if the Company reasonably deems it necessary. The Company shall not be liable for any damages incurred by users as a result of any action taken by the Company in accordance with this provision. You are not a person who is prohibited from using the Service under the laws of Japan or any other applicable jurisdiction of any country.
You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations, and have not been convicted of a felony, sex offense, or any crime involving violence.
Antisocial forces, etc. (meaning organized crime groups, violent groups, right-wing groups, antisocial forces, and other similar parties. The same applies hereinafter.
No falsehoods, errors or omissions in all or part of the registration information provided to the Company
The user is not a person who has been reasonably judged to be in breach or likely to be in breach of the Terms of Use of the Service or tripmate Inc. in the past, or whose registration to use the Service has been cancelled for reasons attributable to the user
The Company has not determined that there is a risk of violation of these Terms of Use.

Article 5 (Account and Use of Services)

To use tipmate, you can sign in using your Google or Facebook login. If you do so, you authorize us to access and use your specific Google and Facebook account information. This may include, but is not limited to, information about your public Facebook profile. For more information about the information we collect from you and how we use it, please see our Privacy Policy.
If you believe that someone has accessed your account, please contact us immediately.
We do not warrant that the Service will be free from defects in fact or in law, including, but not limited to, defects in security, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security or otherwise, errors or bugs, or infringement.
The Company does not warrant that the Services will be compatible with all computers, smartphones, tablets, or operating systems.
The Company shall not be liable for any loss or damage arising from the inability to use the Service due to the User's environment.
tripmate is constantly working to improve the service and provide useful additional features. This means that we may add new product features or enhancements from time to time, or remove some features. Where these actions do not materially affect your rights or obligations, we will not give you prior notice. There may be times when the service may be suspended completely. In such cases, we will notify you in advance, unless circumstances such as safety or security concerns prevent us from doing so.

Article 6 (Prohibited Activities)

By using this service, you agree not to do any of the following.
Useing the Service for any purpose that is unlawful or prohibited by this Agreement.
Useing the Service for any harmful or improper purpose.
Violating the Community Guidelines, as updated from time to time.
Spam, claims for money from users or fraud.
Impersonating others or posting images of others without permission.
Bullying, 'stalking', threats, attacks, harassment, abuse or defamation.
Posting content that infringes or violates any person's rights, including rights of publicity, privacy, copyright, trademark, or other intellectual property or contractual rights.
Posting content that is malicious, threatening, sexually explicit or pornographic; or incites violence; or contains nudity, graphic or unwarranted violence.
Posting content that promotes racism, bigotry, hatred, or physical harm of any kind to any group or individual.
Soliciting passwords from other users for commercial or unlawful purposes, asks for personally identifying information, or disseminates personal information about others without their permission.
Using another user's account, share an account with another user, or maintain multiple accounts.
Capturing or otherwise reproduce, use or publish images from the Service, including member icon images and sub-photos, without the Company's consent
The act of violating the laws and regulations of Japan or the country or region where the user is located when using the service
Posting, posting, disclosing, providing or transmitting (collectively, "Posting") any material that is offensive to social norms, public order and morals, infringes the rights of others, or is otherwise objectionable to others
Directly or indirectly providing benefits to anti-social forces in relation to this service
Disclosing the personal information of third parties
Registration and use of this service by persons under 18 years of age (including high school students)
Impersonating a child
Any act or content that is offensive to public order and morals, such as sexually explicit, cruel, incriminating, or discriminatory
expressions. Impersonating a third party
Misrepresenting the identity of a third party by publishing false information in the contents
Defaming the reputation or social credibility of a third party, or causing offence or emotional damage
Election campaigning or similar activities, or activities in breach of the Public Offices Election Act
Collecting the personal information of third parties such as natural persons, corporations, groups or organisations other than the user, including content viewers
Infringing the intellectual property rights of a third party, or inducing infringement of copyright or portrait rights
Except when permitted by the Company, the use of text, images, member nicknames, icon images, sub-photos, profile information, self-introduction text, and other member information on the service without permission (even mosaic, if the Company has not given permission, will be considered unauthorized use)
Interference with the operation of this service
The amount of data transfer that the Company deems may interfere with the operation of the service, the act of burdening the server (such as unauthorized continuous access)
Commercial advertising (e.g., sending messages to a specific or unspecified number of users in order to direct them to adult-related services)
Disclosing harmful computer viruses, codes, files, programs, etc., or suggesting where they may be found
The act of posting content that is, or may be, a pyramid scheme or similar, or that the Company deems to be, or may be, a pyramid scheme or similar
Posting a photo that tripmate has determined does not represent the actual person The posting of child pornography, or content similar to child pornography, or content that the Company deems to be similar to child pornography
Posting links to sites with content that the Company deems to depict genitalia, such as genitalia-exposing images, videos, or data depicting genitalia
Posting content that disseminates information that the user knows to be false or misleading, content that promotes illegal activities, or content that promotes abusive, threatening, obscene, defamatory, or documented defamatory behaviour
The posting of content that falsely implicates a person under the age of 18 in a sexual or violent manner. Post content that seeks passwords or personal information from other users for commercial or illegal purposes
Posting content that provides descriptions of illegal activities, such as the manufacture or purchase of illegal weapons, invasion of another person's privacy, or the production of computer viruses
Posting content that contains pages that are not open to the public or that can only be accessed with a password
Posting content that involves commercial activities or sales without our prior written permission, such as contests, lotteries, bartering, advertising or pyramid schemes
tripmate reserves the right to investigate and/or suspend your account without refund of any amount due if you breach this agreement, abuse the service or if tripmate considers it inappropriate or illegal (including any action or communication occurring on or offline). We reserve the right to investigate and/or suspend your account without refund of the amount paid.

Article 7 (User's Responsibility and Duty of Care)

Users shall use the Service at their own risk, and shall be responsible for all content published by them.
You agree to indemnify, defend and hold us harmless from and against any and all claims, liabilities and damages arising out of or in connection with your use of this service.
You are responsible for maintaining and safeguarding your tripmate account and shall not lend, give, transfer, trade or sell it to any third party. You agree to indemnify and hold us harmless from any and all disputes or claims for damages arising out of the theft of your tripmate account by any third party, including but not limited to alteration or falsification of your content or unauthorized access to your personal information.
The user acknowledges that the Company has the right to claim compensation for damages if the user causes damage to the Company in any of the actions set forth in this Article.
The Company may suspend or discontinue all or part of the use of this service without prior notice to the user in any of the following cases.
In the event of a problem with your computer system, please contact us for further information. The Company shall not be liable for any loss or damage arising from the use of this service.

The Company shall not be liable for any damages incurred by users based on measures taken by the Company in accordance with this Article.

Article 8 (Prohibited Matters)

Users shall not engage in any of the following acts when using this service. In the event that the Company reasonably deems that a User has committed or is likely to commit any of these prohibited acts, the Company may, without notice to the User, delete the relevant data, display a warning to the User, or restrict the use of the Service or force the User to withdraw from the Service. However, the Company shall not be obliged to suspend publication or delete the relevant data, etc., and the Company shall not be obliged to explain the deletion of data and restrictions on use, etc. In addition, the Company shall not be liable for any damages incurred by users based on measures taken by the Company in accordance with this Article.

Article 9 (Restrictions on Use of the Service)

While we are unable to monitor your activities outside of the Service, it is a violation of this Agreement to use information obtained from the Service to harass, abuse, or harm another person, or to contact, advertise, solicit, or sell to other members without their prior express consent. It is also a breach of these Terms and Conditions. In order to protect our members from such advertising or solicitation, we reserve the right to limit the number of emails you may send to other members in any 24 hour period to a number that is reasonable and appropriate in our sole discretion.

Article 10 (Term and Termination of Contract)

This contract is valid as long as the user is a member of the Service. If the user chooses to become a member and participate in the Service, the user has chosen to start the Service immediately, and no cooling off is allowed.
You may terminate your membership at any time and for any reason by sending us a notice of termination of contract via the Service's withdrawal request form. Please contact us via the withdrawal request form. You may also terminate your membership by contacting our customer support and following our prescribed procedures for verifying your identity.
We reserve the right to immediately terminate your membership, remove any prohibited content and terminate your use of the service at any time if you breach, or we reasonably believe that you may have breached, one or more of the terms of this agreement. In this case, we will send a termination notice to the email address you have registered with tripmate. In addition, we may prohibit you, permanently or temporarily, from accessing all or any part of the service.
In the event that a user's membership registration is cancelled, the user withdraws from the service, or the user loses membership for any other reason, no refunds will be made (nor will refunds be made on a pro-rata basis) for any paid services, even if the period of use purchased by the user has not yet expired. If you have purchased any of our rights services, they will expire at the same time as you lose your membership, regardless of the expiry date, and you will not be able to use them.
In the event that a user terminates their paid services while they are still a member, they will not be able to use any of the paid services, even if there is still a period of use purchased by the user prior to the termination. No refunds, including pro-rated refunds, will be made.
If you are not a paying member, the Service may disable the account of any member who has not used the Service for more than 6 months (counting from the date of last connection to the Service)

Article 11 (Prohibition of Reuse)

In the event that a user uses the Service or the data comprising the Service for purposes other than those for which the Service is provided, the Company reserves the right to stop the user from doing so and to claim an amount equivalent to the profit earned by the user from these actions.

Article 12 (Free Membership, Paid Membership, and Usage Fees)

The Service is available free of charge for certain services and functions. In order to use additional functions, you need to become a paid member of the Service. Please see the description page for details of the latest paid membership plans and prices. Please note that the subscription policy disclosed to you when you subscribe to the Service is part of this Agreement. In order to use additional features and services, such as communicating with other members, you must become a paid member of the Service. Please note that we are unable to accept any changes or cancellations after you have applied for this service. Please note that we do not provide any refund or pro-rated settlement for the unused period of the paid service, even if you suspend or cancel the paid service in the middle of the usage period (please use the cancellation form to cancel the membership). Please note that paid services will be renewed automatically unless you opt out of automatic renewal. Please see our help section for more information.

Article 13 (Deletion of Postings, etc., Suspension of Service, and Account Deletion)

You are solely responsible for the content that you post or otherwise transmit to the Service and for the content that you transmit to other members through the Service. Whenever you post, you represent and warrant that the Content is (a) accurate, (b) does not violate this Agreement, and (c) will not harm anyone in any way. In order to ensure the proper operation of the services we provide, we reserve the right to take action, without prior notice, such as deleting data or content, denying access to all or part of the services, or deleting a user's account in the following cases:

If you do not agree to the terms and conditions of this Agreement, you may not use the services.

If you breach, or we reasonably believe that you may have breached, any of the terms and conditions of this Agreement
In the event of a delay in payment of any amount owed to the Company
If your credit card or bank account has been suspended
as a means of payment for the Service. In the event that the Company determines that there is a credit risk to the User, such as the User being petitioned for bankruptcy or civil rehabilitation proceedings, or the User himself filing such a petition
In the event that your account has been registered or used by an antisocial force or its members or affiliates, or if the Company determines that there is a risk of such an event
If you have not used your account or a particular service for a period of time
In the event that the Company determines that it is difficult to maintain the contractual relationship between the Company and the User, such as when the relationship of trust with the User is lost
In the event of a breach of these Terms and Conditions, the Company shall not be liable for any loss or damage arising from such breach.


In the event of any discrepancy between this translated text and the original Japanese text, the original Japanese text shall prevail. The user agrees that the Company may read and delete messages for the purpose of preventing accidents and ensuring the sound operation of the service. Article 14 (Compensation to the Company)

The contents posted by users (including, but not limited to, location information, image data, and text. With regard to the posted contents, the user shall be deemed to have granted the Company the right (including the right to sublicense) to use (including reproduction, showing, public transmission, exhibition, distribution, transfer, lending, translation, adaptation, and publication) the contents free of charge and on a non-exclusive basis both within and outside of Japan without any time limit. However, the content of messages between users shall be respected in privacy and shall not be included in the scope of the license granted in this article. In addition, users shall not exercise their moral rights. All copyrights and other intellectual property rights for this service and all information related to this service, except for the copyrights for posted content generated by users using this service, belong to this company or the right holders who have authorized this company to use them, and users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for business purposes without permission. This company does not grant the use of posted content to other users or other third parties, except for the users themselves, and users shall not commit any acts that infringe on the rights of other users' posted content. In addition, users shall not perform any act to automatically collect or analyze posted content by crawling or other means. The company does not guarantee any damage caused to users by the use of the posted contents of other users. In addition, in the event that a user profits from the use of another user's posted content, the Company shall have the right to claim money equivalent to that profit.

Article 16 (Communication or Notification)

Unless otherwise provided in these Terms and Conditions, users shall use the Contact Us form to contact the Company. We do not accept telephone contact or visits. We will not be liable for any detriment caused if you do not provide us with accurate contact details

Article 17 (Transfer of rights and obligations, etc.)

Users may not transfer or lend all or part of their contractual status and the rights and obligations arising therefrom to any third party in connection with any contract under these Terms and Conditions. In the event that the Company transfers the business of the Service to another company, the Company may transfer the status of the User Agreement, the rights and obligations under the Terms and Conditions, the User's registration information and other customer information to the transferee of the transfer, and the User agrees in advance to such transfer in this paragraph. Article 18 (Disputes between Members)

Users shall use the Service at their own risk and shall be solely responsible for their interactions with other members of the Service. We reserve the right, but have no obligation, to monitor disputes that arise between you and other members of the Service.

Article 19 (Privacy)

The use of the Service is also governed by our Privacy Policy. Any personal information you provide to us (including sensitive personal information) will be stored on our computers. You agree that we may use this information to create a profile of your interests, preferences and browsing patterns and to enable you to participate in the Services

Article 20 (Relationship with Facebook and Google)

The Company shall not be liable for any loss of use of the Service through Facebook or Google as a result of any breach by you of the Terms of Use and Privacy Policy of Facebook or Google. We shall not be liable for any loss of use of the Services as a result of the interruption, blocking, closure or termination of your Facebook or Google account for any reason. If you have used Facebook or Google to create an account for the Service and you are unable to use Facebook or Google due to withdrawal from Facebook or Google or for any other reason, you will not be able to use the Service either. In this case, the user shall be responsible for canceling the membership of the Service, and the Company shall not be liable for any charges incurred due to the failure to do so.

Article 21 (Restriction of activities that induce children)

This service is designed to regulate the use of the Internet Dating Service to attract children. Article 22 (Disclaimer)

Article 23 (Notice on the use of the Service)

Since the Service is used by an unspecified number of people, there is a possibility that the Service may be abused in some cases. We ask you to be aware of this possibility and to use the Service with caution and to think carefully about how you interact with other members, especially those with whom you exchange messages, and about the personal information you disclose. We do not guarantee that all of our members are over 18 years of age. If you choose to provide other members with any means of communication outside of the Service, or disclose any personal or sensitive information, you do so at your own risk. If you find a member in breach of these Terms and Conditions, please report it immediately using the Report a Violation button or Contact Us.

Article 24 (Changes to the Service and Terms of Use)

The Company reserves the right to amend these Terms of Use at any time without prior consent of the User, if the Company deems it necessary. In addition, the Company shall notify users of any revisions at any time. If you use the Service after the revision of this Agreement, you will be deemed to have accepted the contents of this Agreement after the revision.

Article 25 (Governing Law)

This Agreement shall be governed by and construed in accordance with the laws of Japan.

Article 26 (Court of Jurisdiction)

In the event of the need for litigation between the user and the Company, the Tokyo District Court shall be the exclusive jurisdictional court of first instance.

Article 27 (Supplementary Provisions) About Mate chip/PWTW function)

Although all the features of the tripmate service are free of charge, in order to better connect the world, people from different cultures, and to develop a more satisfying user experience, tripmate has a "Mate Tip" (PWTW) feature. This is a system in which the user decides how much money he or she wants to pay to tripmate for the service, when the user is satisfied with the service. It is your responsibility to pay for the activities you choose to support through this service, and tripmate is not responsible for any payment made through this service or its consequences. This is the price that tripmate receives for its services and tripmate does not guarantee to the user that the donation made by the user will be deductible. The use of any payment made by the user is at the sole discretion of tripmate and not at the discretion of the user who made the payment, and tripmate shall not be held responsible for this. Once tripmate has received the money from the user through Mate Chip/PWTW, it is not possible to return it for any reason whatsoever.
